نحيط سعادتكم علما بصدور المرسوم رقم ( ٩ ) بشأن إعفاء المشاريع المدعومة من صندوق خليفة لتطوير المشاريع في إمارة عجمان والذي يحتوى على إعفاء الصندوق ذاته من الرسوم المحلية ونرفق طي هذا الكتاب أصل للمرسوم الصادر للعمل بموجبه متمنين لكم التوفيق والنجاح.

بشأن إعفاء المشاريع المدعومة من صندوق خليفة

لتطوير المشاريع في إمارة عجمان

نحن حميد بن راشد النعيمي ، عضو المجلس الأعلى ، حاكم إمارة عجمان.

بعد الإطلاع على القانون المحلي رقم ( ١٤ ) لسنة ٢٠٠٥ ، الصادر عن صاحب السمو حاكم أبوظبي في شأن صندوق خليفة لتطوير المشاريع وتعديلاته.

وتطبيقاً للتوجيهات السامية لصاحب السمو رئيس الدولة - حاكم إمارة أبوظبي، بتوسيع خدمات الصندوق لتشمل كافة إمارات الدولة.

وحرصا منا على دعم مشاريع الشباب من المواطنين في إمارة عجمان وتشجيعاً لهم على الدخول في مشاريع مبتكرة وذات جدوى إقتصادية في مجالات الأعمال التجارية والصناعية ، ولزيادة مساهماتهم الفعالة في دعم الإقتصاد الوطني من خلال مشاريعهم الصغيرة والمتوسطة.

وبناءاً على توصية المجلس التنفيذي بالإمارة بجلسته الثالثة، ولما إرتأينا فيه تحقيق الصالح العام.

قررنا إصدار المرسوم الآتي نصه :

المادة (۱)

اسم المرسوم وبدء العمل به

يسمى هذا المرسوم "المرسوم الأميري رقم (۹) لسنة ۲۰۱۱ بشأن إعفاء المشاريع المدعومة من صندوق خليفة لتطوير المشاريع في إمارة عجمان" ويعمل به من تاريخ التوقيع عليه.

المادة (٢)

تعريفات

لأغراض تطبيق أحكام هذا المرسوم، يقصد بالكلمات التالية المعاني الموضحة قرين كل منها أدناه، ما لم يقض سياق النص خلاف ذلك:

"الإمارة " : يقصد بها إمارة عجمان.

"الصندوق " : يقصد به فرع صندوق خليفة لتطوير المشاريع في إمارة عجمان.

"الدوائر المحلية " : يقصد بها الدوائر والإدارات التابعة لحكومة عجمان، وتشمل العبارة: غرفة تجارة وصناعة عجمان.

"الرسوم المحلية": يقصد بها أية رسوم محلية تم فرضها بموجب مرسوم أميري، أو قرار أميري، أو قرار إداري، أو أمر محلي وتقوم تحصيلها الدائرة المحلية المعنية، ولا تشمل العبارة الرسوم الجمركية أو الرسوم المتعلقة بنظام الصرف الصحي.

"المشاريع المدعومة " : يقصد بها المشاريع التجارية أو الحرفية أو المهنية أو الصناعية أو التنموية في الإمارة، والتي يقوم الصندوق بدعمها وتطويرها.

المادة (۳)

إعفاء من الرسوم المحلية

۳ (۱) - يعفى الصندوق من الرسوم المحلية المطبقة في الإمارة.

۳ (۲) - تعفى المشاريع المدعومة من قبل الصندوق من الرسوم المحلية المطبقة في الإمارة للمدة التي تقررها إدارة الصندوق.

۳ (۳) - لا يجوز منح أي إعفاء بموجب الفقرة (۳(۲)) أعلاه، إلا بعد قيام طالب الإعفاء بتقديم كتاب من الصندوق يتضمن توصية من الصندوق موجه إلى الدائرة المحلية المعنية بإعفاء المشروع المعني من الرسوم المحلية المقررة.

المادة (٤)

نشر المرسوم وتعميمه

ينشر هذا المرسوم في الجريدة الرسمية للإمارة ويعمم على جميع الجهات المعنية بتنفيذه كل فيما يخصه.

صدر عنا بتوقيعنا وخاتمنا عليه بديواننا الأميري في عجمان في هذا اليوم الخميس الثلاثون من شهر جمادى الآخر سنة ١٤٣٢ هجرية الموافق الثاني من شهر يونيو سنة ٢٠١١ ميلادية.

Subject / Decree on the Exemption of Projects Supported by the Khalifa Fund

We would like to inform Your Excellency of the issuance of Decree No. (9) regarding the exemption of projects supported by the Khalifa Fund for Enterprise Development in the Emirate of Ajman, which includes the exemption of the Fund itself from local fees. We attach herewith the original decree issued to be acted upon, wishing you all success.

Emiri Decree No. (9) of 2011

Concerning the Exemption of Projects Supported by the Khalifa Fund

for Enterprise Development in the Emirate of Ajman

We, Humaid bin Rashid Al Nuaimi, Member of the Supreme Council, Ruler of the Emirate of Ajman.

After reviewing Local Law No. (14) of 2005, issued by His Highness the Ruler of Abu Dhabi, concerning the Khalifa Fund for Enterprise Development and its amendments.

And in implementation of the high directives of His Highness the President of the UAE - Ruler of the Emirate of Abu Dhabi, to expand the Fund's services to include all emirates of the country.

And out of our keenness to support the projects of young citizens in the Emirate of Ajman and to encourage them to engage in innovative and economically viable projects in the commercial and industrial business sectors, and to increase their effective contributions to supporting the national economy through their small and medium-sized enterprises.

And based on the recommendation of the Emirate's Executive Council in its third session, and for what we deemed to be in the public interest.

We have decided to issue the following decree:

Article (1)

Name of the Decree and its Entry into Force

This Decree shall be named "Emiri Decree No. (9) of 2011 Concerning the Exemption of Projects Supported by the Khalifa Fund for Enterprise Development in the Emirate of Ajman" and shall come into force from the date of its signature.

Article (2)

Definitions

For the purposes of applying the provisions of this Decree, the following words shall have the meanings assigned to them below, unless the context otherwise requires:

"The Emirate": Means the Emirate of Ajman.

"The Fund": Means the branch of the Khalifa Fund for Enterprise Development in the Emirate of Ajman.

"Local Departments": Means the departments and administrations affiliated with the Government of Ajman, and the phrase includes: the Ajman Chamber of Commerce and Industry.

"Local Fees": Means any local fees imposed by an Emiri Decree, Emiri Resolution, administrative decision, or local order, which are collected by the concerned local department. The phrase does not include customs duties or fees related to the sewage system.

"Supported Projects": Means the commercial, craft, professional, industrial, or developmental projects in the Emirate, which are supported and developed by the Fund.

Article (3)

Exemption from Local Fees

3(1) - The Fund shall be exempted from the local fees applicable in the Emirate.

3(2) - Projects supported by the Fund shall be exempted from the local fees applicable in the Emirate for the period determined by the Fund's management.

3(3) - No exemption may be granted under paragraph (3(2)) above, except after the applicant for exemption submits a letter from the Fund containing a recommendation from the Fund addressed to the concerned local department to exempt the relevant project from the prescribed local fees.

Article (4)

Publication and Circulation of the Decree

This Decree shall be published in the Official Gazette of the Emirate and circulated to all concerned authorities for its implementation, each within its own jurisdiction.

Issued by us with our signature and seal at our Emiri Diwan in Ajman on this day, Thursday, the thirtieth of the month of Jumada al-Akhirah, year 1432 Hijri, corresponding to the second of the month of June, year 2011 Gregorian.
