Concerning
The Second Government Package to Support the Economic Sector
In the Emirate of Ajman
We, Humaid bin Rashid Al Nuaimi, Ruler of Ajman
Having reviewed Emiri Decree No. (8) of 1985 on the application of the Rules and Regulations for Seaports Parts (1-4) issued by the Cooperation Council for the Arab States of the Gulf to the Ajman Seaport,
And Emiri Decree No. (11) of 2011 promulgating the Financial Law of the Government of Ajman and its executive regulations,
And Emiri Decree No. (15) of 2012 concerning the Department of Finance in Ajman and its amendments,
And Emiri Decree No. (4) of 2014 concerning the reorganization of the Executive Council of the Emirate of Ajman and its amendments,
And Emiri Decree No. (17) of 2017 concerning the service fees and violation fines applied by the Department of Land and Real Estate Regulation in Ajman,
And Emiri Decree No. (20) of 2017 concerning the regulation of practicing hotel and tourism activities in the Emirate of Ajman and its amendments,
And Emiri Decree No. (2) of 2018 concerning the Legislation Committee in the Emirate of Ajman,
And Emiri Decree No. (5) of 2018 promulgating the law on regulating the practice of economic activities in the Emirate of Ajman,
And Emiri Decree No. (1) of 2019 concerning fees, taxes, and fines in the Emirate of Ajman,
And Emiri Decree No. (7) of 2020 concerning the government package to support the local community and the business sector in the Emirate of Ajman,
And Emiri Resolution No. (14) of 2013 concerning the registration fees in the register of suppliers, contractors, and consultants at the Department of Finance in Ajman and its amendments,
And Emiri Resolution No. (12) of 2015 concerning the service fees of the Department of Economic Development in Ajman and its amendments,
And Emiri Resolution No. (13) of 2015 promulgating the regulation of violations and their prescribed fines at the Department of Economic Development in Ajman,
And Emiri Resolution No. (20) of 2017 concerning the service fees applied by the Department of Tourism Development in Ajman,
And based on the approval of the Legislation Committee,
We have issued the following Decree:
Article (1)
Objectives of the Decree
This Decree aims to mitigate the effects resulting from the global crisis due to the outbreak of the novel Coronavirus (COVID-19) on the economic sectors in the Emirate of Ajman, and to enable them to overcome the current stage.
Article (2)
Facilities and Incentives for Contractors with Government Entities
Contractors with government entities to which the Financial Law of the Government of Ajman applies shall be granted, as of the date of issuance of this Decree, the following facilities and incentives:
1. Exempting bidders for tenders offered by government entities from paying the sale price of tender specifications, conditions, and documents booklets until 31/12/2020.
2. Exempting suppliers and contractors from submitting a bid bond with each bid until 31/12/2020.
3. Reducing the performance bond to a rate of (5%) of the value of the winning bid until 31/12/2020.
Article (3)
Facilities and Incentives for Beneficiaries of the Department of Finance Services
Suppliers, contractors, and consultants are exempted from registration and renewal fees in the register of suppliers, contractors, and consultants at the Department of Finance until 31/12/2020.
Article (4)
Facilities and Incentives for Beneficiaries of the Department of Land and Real Estate Regulation Services
Beneficiaries of the services of the Department of Land and Real Estate Regulation in Ajman shall be granted the following facilities and incentives:
1. Suspending the calculation of administrative fines resulting from the commission of the following violations, starting from 01/03/2020 for a period of three months:
a. Failure to renew the registration for practicing real estate activities.
b. Delay in renewing the real estate broker card.
c. Failure to renew the accreditation certificate for an owners' association management company.
d. Failure to renew the registration of a main or sub-real estate developer.
e. Failure to renew the registration of a main or sub-real estate project.
f. Failure to extend the completion period of a main or sub-real estate project.
g. Failure to obtain prior approval from the Department to change the contractor or consultant of a real estate project.
2. Extending the validity periods of the following services, which expired from 01/03/2020, for a period of three months:
a. Advertising permits.
b. Registration of a specialized engineering consultant.
c. Accreditation of an escrow agent.
d. Registration of a financial auditor for a real estate project.
Article (5)
Facilities and Incentives for Beneficiaries of the Department of Port and Customs Services
Beneficiaries of the services of the Ajman Department of Port and Customs shall be granted, as of the date of issuance of this Decree, the following facilities and incentives:
1. Payment of customs fees in flexible installments within (90) days.
2. Reducing container insurance fees by (50%) for each container, until 30/06/2020.
3. Extending the free storage period for containers from (10) days to (20) days.
4. Canceling the collection of insurance amounts for the delivery of original shipping documents for a period of two months.
5. Extending the delivery period for original shipping documents from two months to four months.
Article (6)
Facilities and Incentives for Beneficiaries of the Department of Tourism Development Services
Beneficiaries of the services of the Department of Tourism Development in Ajman shall be granted the following facilities and incentives:
1. Exempting hotel and tourism establishments in the Emirate from registration and renewal fees in the register of hotel establishments and the register of tourism establishments at the Department, from the date of issuance of this Decree until 31/12/2020.
2. Suspending the calculation of fines resulting from the delay in renewing licenses for hotel and tourism establishments, starting from 01/03/2020 for a period of three months.
3. Postponing the payment of fines resulting from the commission of other violations by hotel and tourism establishments, from the date of issuance of this Decree until 31/12/2020.
Article (7)
Facilities and Incentives for Beneficiaries of the Department of Economic Development Services
Beneficiaries of the services of the Department of Economic Development in Ajman shall be granted the following facilities and incentives:
1. Suspending the calculation of fines resulting from the delay in renewing licenses for economic establishments and warehouse permits, starting from 01/03/2020 for a period of three months.
2. Postponing the payment of fines resulting from the commission of other violations by economic establishments, from the date of issuance of this Decree until 31/12/2020.
Article (8)
Regulatory Resolutions
The Chairman of the Executive Council of the Emirate may, by a resolution issued by him, extend the periods stipulated in this Decree as he deems appropriate.
Article (9)
Repeals
Any text or provision that conflicts with the provisions of this Decree shall be repealed.
Article (10)
Entry into Force and Publication
This Decree shall enter into force from the date of its issuance and shall be published in the Official Gazette.
Issued by us on this day, Sunday, the nineteenth of the month of Sha'ban 1441 Hijri, corresponding to the twelfth of the month of April 2020 Gregorian.
