الحزمة الحكومية لدعم المجتمع المحلي وقطاع الأعمال

في إمارة عجمان

بعد الاطلاع على المرسوم الأميري رقم (5) لسنة 2002 بشأن رسوم المعاملات ببلدية عجمان وتعديلاته،

وعلى المرسوم الأميري رقم (11) لسنة 2011 بإصدار القانون المالي لحكومة عجمان ولائحته التنفيذية،

وعلى المرسوم الأميري رقم (15) لسنة 2012 بشأن دائرة المالية في عجمان وتعديلاته،

وعلى المرسوم الأميري رقم (4) لسنة 2014 بشأن إعادة تنظيم المجلس التنفيذي لإمارة عجمان وتعديلاته،

وعلى المرسوم الأميري رقم (1) لسنة 2015 بشأن دائرة التنمية الإقتصادية في الإمارة،

وعلى المرسوم الأميري رقم (2) لسنة 2017 بإصدار قانون إيجار العقارات في إمارة عجمان،

وعلى المرسوم الأميري رقم (20) لسنة 2017 بشأن تنظيم مزاولة الأنشطة الفندقية والسياحية في إمارة عجمان وتعديلاته،

وعلى المرسوم الأميري رقم (2) لسنة 2018 بشأن لجنة التشريعات في إمارة عجمان،

وعلى المرسوم الأميري رقم (5) لسنة 2018 بإصدار قانون تنظيم مزاولة الأنشطة الاقتصادية في إمارة عجمان،

وعلى المرسوم الأميري رقم (1) لسنة 2019 بشأن الرسوم والضرائب والغرامات في إمارة عجمان،

وعلى القرار الأميري رقم (4) لسنة 2015 بإصدار لائحة رسوم الخدمات والغرامات المطبقة لدى هيئة النقل،

وعلى القرار الأميري رقم (12) لسنة 2015 بشأن رسوم خدمات دائرة التنمية الاقتصادية في عجمان وتعديلاته،

وعلى القرار الأميري رقم (5) لسنة 2017 بشأن رسوم خدمات النظافة العامة في عجمان وغرامات المخالفات المتعلقة بها وتعديلاته،

وعلى القرار الأميري رقم (20) لسنة 2017 بشأن رسوم الخدمات المطبقة لدى دائرة التنمية السياحية في عجمان،

وعلى القرار الأميري رقم (9) لسنة 2018 بشأن رسوم خدمات قطاع تطوير البنية التحتية في بلدية عجمان وغرامات المخالفات المتعلقة بها،

وعلى القرار الأميري رقم (13) لسنة 2018 بشأن رسوم تصديق عقود الإيجار السكنية لدى دائرة البلدية والتخطيط في عجمان،

وبناء على موافقة لجنة التشريعات،

أصدرنا المرسوم الآتي:

المادة (1)

أهداف المرسوم

يهدف هذا المرسوم إلى تحقيق الآتي:

1. المساهمة في تخفيف الأعباء المالية على المجتمع المحلي وقطاع الأعمال.

2. الإسهام في تجاوز الآثار الاجتماعية والاقتصادية الناجمة عن الأزمة العالمية الناجمة عن تفشي فيروس كورونا المستجد (كوفيد-19).

3. تمكين القطاعات الاقتصادية والخدمية في الإمارة من تجاوز المرحلة الراهنة ودفعها لمواصلة مراكزها المتقدمة.

المادة (2)

الإعفاء من بعض الرسوم الحكومية

اعتباراً من تاريخ سريان هذا المرسوم يُعفى من الرسوم الحكومية المقررة للخدمات التالية وللمدد المحددة إزاء كل منها:

1. منح تصريح عمل للمنشأة لمدة (24) ساعة طيلة أيام الأسبوع، أو لساعات إضافية في الإمارة، وذلك لمدة سنة، وتحدد الأنشطة المشمولة بهذا الإعفاء بقرار يصدر عن رئيس دائرة التنمية الاقتصادية.

2. إصدار أو تجديد تصنيف المنشآت السياحية والفندقية في الإمارة، وذلك حتى تاريخ 2020/12/31.

3. ترخيص المنشآت السياحية والفندقية في الإمارة، وذلك حتى تاريخ 2020/12/31.

4. تصريح أو تأجيل أو إلغاء الفعاليات في الإمارة، وذلك حتى تاريخ 2020/12/31.

5. مواقف المركبات في المناطق المخصصة بالإمارة، وذلك حتى تاريخ 2020/4/30.

المادة (3)

الإعفاء من رسوم اتفاقية امتياز مركبات الأجرة

اعتباراً من تاريخ سريان هذا المرسوم يُعفى أصحاب حقوق الامتياز المتعاقدون مع هيئة النقل من رسوم اتفاقية امتياز مركبات الأجرة في الإمارة بنسبة (50%)، وذلك حتى تاريخ 2020/6/30.

المادة (4)

تخفيض بعض الرسوم الحكومية

اعتباراً من تاريخ سريان هذا المرسوم تُخفض الرسوم المقررة للخدمات الحكومية التالية بالنسب والمدد المحددة إزاء كل منها:

1. خدمات النظافة العامة بنسبة (30%)، وذلك حتى تاريخ 2020/12/31.

2. تصديق العقود الإيجارية (تجارية وسكنية) بنسبة (20%)، وذلك حتى تاريخ 2020/6/30.

3. تصاريح التنزيلات والعروض التجارية بنسبة (50%)، وذلك حتى تاريخ 2020/6/30.

المادة (5)

القرارات التنظيمية

لرئيس المجلس التنفيذي في الإمارة بموجب قرار يصدر عنه تمديد مدد الإعفاء والتخفيض المنصوص عليها في هذا المرسوم وفقاً لما يراه مناسباً.

المادة (6)

الإلغاءات

يُلغى أي نص أو حكم يتعارض مع أحكام هذا المرسوم.

المادة (7)

السريان والنشر

يعمل بهذا المرسوم من تاريخ 2020/04/05، ويُنشر في الجريدة الرسمية.

صدر عنا في هذا اليوم الاثنين الموافق السادس من شعبان 1441 هجرية، الموافق الثلاثون من شهر مارس سنة 2020 ميلادية.

Emiri Decree No. (7) of 2020 Concerning

The Government Package to Support the Local Community and Business Sector

in the Emirate of Ajman

We, Humaid bin Rashid Al Nuaimi, Ruler of Ajman

After reviewing Emiri Decree No. (5) of 2002 regarding transaction fees at Ajman Municipality and its amendments,

And Emiri Decree No. (11) of 2011 issuing the Financial Law of the Government of Ajman and its executive regulations,

And Emiri Decree No. (15) of 2012 regarding the Department of Finance in Ajman and its amendments,

And Emiri Decree No. (4) of 2014 regarding the reorganization of the Executive Council of the Emirate of Ajman and its amendments,

And Emiri Decree No. (1) of 2015 regarding the Department of Economic Development in the Emirate,

And Emiri Decree No. (2) of 2017 issuing the Real Estate Lease Law in the Emirate of Ajman,

And Emiri Decree No. (20) of 2017 regarding the regulation of hotel and tourism activities in the Emirate of Ajman and its amendments,

And Emiri Decree No. (2) of 2018 regarding the Legislation Committee in the Emirate of Ajman,

And Emiri Decree No. (5) of 2018 issuing the law on regulating the practice of economic activities in the Emirate of Ajman,

And Emiri Decree No. (1) of 2019 regarding fees, taxes, and fines in the Emirate of Ajman,

And Emiri Decision No. (4) of 2015 issuing the regulation of service fees and fines applied by the Transport Authority,

And Emiri Decision No. (12) of 2015 regarding the service fees of the Department of Economic Development in Ajman and its amendments,

And Emiri Decision No. (5) of 2017 regarding public cleaning service fees in Ajman and related violation fines and its amendments,

And Emiri Decision No. (20) of 2017 regarding service fees applied by the Department of Tourism Development in Ajman,

And Emiri Decision No. (9) of 2018 regarding service fees for the infrastructure development sector at Ajman Municipality and related violation fines,

And Emiri Decision No. (13) of 2018 regarding the fees for attesting residential lease contracts at the Department of Municipality and Planning in Ajman,

And based on the approval of the Legislation Committee,

We have issued the following decree:

Article (1)

Objectives of the Decree

This decree aims to achieve the following:

1. To contribute to alleviating the financial burdens on the local community and the business sector.

2. To contribute to overcoming the social and economic effects resulting from the global crisis caused by the outbreak of the novel Coronavirus (COVID-19).

3. To enable the economic and service sectors in the Emirate to overcome the current stage and push them to continue their advanced positions.

Article (2)

Exemption from Certain Government Fees

As of the effective date of this Decree, the following services shall be exempted from the prescribed government fees for the periods specified for each:

1. Granting a work permit for an establishment for 24 hours throughout the week, or for additional hours in the Emirate, for a period of one year. The activities covered by this exemption shall be determined by a decision issued by the Chairman of the Department of Economic Development.

2. Issuing or renewing the classification of tourist and hotel establishments in the Emirate, until 31/12/2020.

3. Licensing of tourist and hotel establishments in the Emirate, until 31/12/2020.

4. Permitting, postponing, or canceling events in the Emirate, until 31/12/2020.

5. Vehicle parking in designated areas in the Emirate, until 30/04/2020.

Article (3)

Exemption from Taxi Vehicle Concession Agreement Fees

As of the effective date of this Decree, concessionaires contracted with the Transport Authority shall be exempted from 50% of the taxi vehicle concession agreement fees in the Emirate, until 30/06/2020.

Article (4)

Reduction of Certain Government Fees

As of the effective date of this Decree, the prescribed fees for the following government services shall be reduced by the percentages and for the periods specified for each:

1. Public cleaning services by 30%, until 31/12/2020.

2. Attestation of lease contracts (commercial and residential) by 20%, until 30/06/2020.

3. Permits for sales and commercial offers by 50%, until 30/06/2020.

Article (5)

Regulatory Decisions

The Chairman of the Executive Council of the Emirate may, by a decision issued by him, extend the exemption and reduction periods stipulated in this Decree as he deems appropriate.

Article (6)

Repeals

Any text or provision that contradicts the provisions of this Decree shall be repealed.

Article (7)

Entry into Force and Publication

This Decree shall come into force from 05/04/2020, and shall be published in the Official Gazette.

Issued by us on this day, Monday, the sixth of Sha'ban 1441 AH, corresponding to the thirtieth of March 2020 AD.
